NSA Clearance Appeals: How an Intelligence Agency Process Differs From DOHA

Posted by Ashley Jones

NSA clearance appeals are not automatically DOHA cases. DoD Directive 5220.6 excludes cases involving Sensitive Compartmented Information or a special access program. If an Intelligence Community element denies or revokes SCI or other controlled-access eligibility, ICPG 704.3 covers the IC process whether you are a direct hire or a contractor employee; DOHA may handle a contractor’s collateral clearance case. Start with the adverse notice, which should identify the determination, authority, deadline, and submission route.

First: Identify whether the notice concerns clearance or access eligibility, suitability, psychological processing, or hiring.

Second: Use the authority and contact printed on the notice, not a generic appeal template.

Third: Request permitted records promptly and preserve proof of receipt.

Fourth: Build the written record before any personal appearance offered as determined by the head of the IC element.

Fifth: Treat every stated deadline as controlling and seek qualified advice early if needed.

Why are NSA clearance appeals not automatically sent to DOHA?

NSA is an Intelligence Community element, while DOHA’s industrial program covers a defined class of contractor clearance cases. The customer’s identity does not select the forum by itself. Your employer, the adjudicating organization, the kind of eligibility at issue, and the notice’s cited authority matter.

The federal government’s official Intelligence Community roster includes the National Security Agency. ODNI’s publicly posted ICPG 704.3, effective October 2, 2008, applies across IC elements and addresses denials or revocations of initial or continued SCI and other controlled-access eligibility within its scope.

DOHA is not shorthand for every unfavorable clearance decision. Its Industrial Security Program handles cases under DoD Directive 5220.6 involving contractor personnel doing classified work for DoD components, but the directive states in paragraph 2.6 that it does not apply to SCI or special-access-program cases. A contractor’s collateral clearance may follow DOHA’s industrial route; an IC denial or revocation of that contractor’s SCI or other controlled access follows the IC element’s process under ICPG 704.3.

Employment category alone does not select the forum. Identify the type of eligibility at issue and use the form, contact, and deadline stated by the adjudicating authority.

Is the adverse action about clearance eligibility, suitability, or hiring?

Classify the action before drafting a response. A denial or revocation of access eligibility is different from an unfavorable psychological or employment-suitability result, a withdrawn vacancy, or stopped candidate processing. Similar practical outcomes can arise from different authorities and review rights.

NSA’s published candidate suitability process has two parts: security processing and psychological processing. It says the security team makes the clearance eligibility determination under SEAD 4 criteria, while psychological processing is separate. Successful completion of both is required before a final job offer.

That separation prevents a common reasoning error. A favorable security determination does not by itself require NSA to complete a hire, and an employment outcome does not necessarily mean clearance eligibility was denied. The label “suitability process” on the careers page describes the wider pre-employment process; the notice should identify the particular action taken in your case.

NSA also states in its published application process that processing can stop when the original position is no longer available and that candidates may still apply or be considered elsewhere. That is a hiring event, not proof of an adverse security adjudication.

What should the adverse notice tell you?

Look for the exact determination, factual or guideline concerns, deciding office, response right, due date, permitted submission method, records-request instructions, and later appeal route. Preserve the envelope, email headers, attachments, and the date you received every item.

Under ICPG 704.3, a subject within its scope is to receive a comprehensive written explanation of the basis for denial or revocation as national-security interests and applicable law permit. The explanation and produced record may therefore withhold material that cannot lawfully be provided.

The notice may use “denial,” “revocation,” “access,” “eligibility,” “suitability,” or “discontinuance” with deliberate differences. Quote its words in your case chronology instead of translating every outcome into “my clearance was denied.”

If the notice is unclear, ask the listed office in writing which determination was made, which review process applies, and how its deadline is calculated. The official instructions remain controlling regardless of a recruiter’s, facility security officer’s, online commenter’s, or another agency’s view.

What safeguards does ICPG 704.3 describe?

For a covered SCI or controlled-access denial or revocation, the guidance describes written reasons within lawful disclosure limits, representation at the subject’s expense, records requests, a written response, notice of review results, an appeal, and a personal-appearance opportunity as determined by the head of the IC element. The conditions attached to each procedure still apply.

The subject is to receive an explanation of the right to counsel or another representative at personal expense. The subject may request documents, records, or reports supporting the action and the investigative file as national security and applicable law permit, which can result in withheld or redacted material.

The policy gives the subject an opportunity to respond in writing and request review. After that review, it calls for written notice and reasons for the result, the deciding authority’s identity consistent with operational requirements, and notice of the appeal right.

The exceptions are substantial. When the head of an IC element or designee certifies that a procedure would damage national-security interests, ICPG 704.3 D.2 says that certification is conclusive; an appeal may also be denied when the procedures cannot be invoked consistently with national security. Under D.3, the DNI or Principal Deputy DNI may take lawful action on access without regard to this or any other regulation or directive. The guidance does not itself create a right to administrative or judicial review.

How do records requests and deadlines work?

ICPG 704.3 describes production of supporting records within 30 days of request, but only to the extent those materials would be provided under applicable law. It then describes a written response within 45 days after receipt of relevant documentation. Your notice may supply the operational instructions you must follow.

Make the records request promptly and exactly as directed. Ask for the documents, reports, and records on which the action was based and the investigative file to the extent permitted. Keep the request, delivery confirmation, agency acknowledgment, and every production letter.

Track separate dates: receipt of the adverse notice, submission of the records request, receipt of each production, and the response deadline stated by the agency. If records arrive in parts or the notice and guidance appear to conflict, ask the issuing office for written clarification before treating the clock as paused.

A qualified attorney can help interpret the notice and protect deadlines, but ICPG 704.3 places counsel or other representation at the subject’s expense. Nothing in the policy promises appointed counsel.

What belongs in the written response?

Answer the stated concerns with relevant facts and documents. Organize the response around the notice, not around a generic defense of your character. A clear chronology, direct admissions or corrections, context, rehabilitation, current conduct, and corroboration are usually more useful than volume.

Start with a chart matching each allegation or concern to your answer and exhibit. Identify factual errors precisely. When a fact is accurate, explain its circumstances without minimizing it. Show changes with records: compliance documents, treatment or counseling records when appropriate and lawfully obtainable, financial records, training, evaluations, or declarations from people with firsthand knowledge.

Do not include classified information in an unclassified submission or use channels the notice does not authorize. If a needed fact is sensitive, ask the issuing office or counsel how it can be handled. Preserve the exact final packet and proof of timely delivery.

The broader overview of appealing a security-clearance decision helps frame mitigation. Your NSA response still must follow the agency notice and IC scope rather than a universal form.

Is a personal appearance the same as a DOHA hearing?

No. ICPG 704.3 provides an opportunity to appear before an adjudicative or other authority, different from the investigating entity, “as determined by the Head of an IC Element.” A summary or recording becomes part of the security record. The notice should say whether and how the appearance is offered; it does not become a DOHA industrial hearing.

Use the stated procedure to confirm the format, attendees, counsel’s role, exhibit method, and whether questions will be asked. Prepare from the written record. The appearance should clarify evidence and credibility, not introduce an inconsistent theory at the last moment.

The comparison with DOHA clearance hearings is useful only after you confirm the forum. DOHA procedures, burdens, published decisions, and appeal instructions cannot be pasted onto an internal IC process merely because both concern national-security eligibility.

Who decides the IC appeal?

The guidance provides an appeal to the head of the IC element. The element head may make the final determination or appoint a high-level panel with at least 3 members, including 2 selected from outside the security arena. Panel recommendations are written; the element head may retain final authority.

Address an IC access appeal to the authority named in the IC element’s notice, not the DOHA Appeal Board. For a separate collateral-clearance case, follow the caption, recipient, delivery method, and document rules in that case’s notice.

Study the review decision before appealing. Separate unresolved factual disputes, misapplied evidence, overlooked mitigation, and procedural questions. Cite the existing record accurately. If new evidence is accepted, explain why it matters and why it was not submitted earlier.

The explanation of a revoked clearance and the appeal process can help current clearance holders plan immediate employment and access questions. It does not replace the NSA contact and deadline in an IC-element notice.

What should you do on the day you receive the notice?

Save an unchanged copy, record the receipt time and method, and calendar every deadline stated. Identify the action and authority in the first paragraph. Send any permitted records request, then obtain advice before making admissions or missing a response window.

Contact the office named in the notice for procedural questions and your recruiter for hiring status; recruiting staff do not adjudicate the security case. If you work for a contractor, involve the facility security officer while preserving the official channel to the adjudicating authority.

Build one chronology and one exhibit index. Keep suitability, psychological, hiring, and access documents in separate sections. Before using any online NSA clearance appeal template, compare its forum, authority, recipient, and deadline against your own notice.

Frequently Asked Questions

Does every NSA clearance denial go to DOHA?

No. An NSA denial or revocation of SCI or other controlled-access eligibility follows the IC element’s process whether the subject is a direct hire or contractor employee. DOHA may handle a contractor’s collateral-clearance case, but Directive 5220.6 excludes SCI and special-access-program cases. Confirm the route in the adverse notice.

Can I appeal an NSA suitability or hiring decision under ICPG 704.3?

Not merely because it affected your candidacy. The policy’s stated scope concerns denial or revocation of SCI and other controlled-access eligibility. Read the notice to determine whether a separate suitability or employment review exists.

Am I entitled to the entire investigative file?

The guidance allows a request, but access is limited by national-security interests and applicable law. Request the supporting materials promptly and use the agency’s production letter to identify anything withheld or redacted.

Can I have a lawyer for an IC appeal?

ICPG 704.3 calls for an explanation of the right to counsel or another representative at your expense. Confirm appearance and submission rules with the agency; the guidance does not promise appointed counsel.

What is the safest first action after an adverse notice?

Preserve the notice and receipt evidence, identify the exact determination and deadline, and follow its records-request and contact instructions. Use a DOHA form or another agency’s procedure only after confirming that it governs your forum.
