Suitability Responses During a Federal Probationary Period: What Process Applies

Posted by Ashley Jones

A federal employee on probation should respond to a clearance or suitability notice under the authority actually cited in that notice. Probationary status does not make every concern a suitability action. A covered appointee facing an agency proposal under Part 731 has specified notice and written-response protections; an employment termination under another authority follows its own process.

Read the proposed action before drafting a defense of your entire career. Identify who issued it, what decision is proposed, which authority applies, and where the response must go. The same underlying event can raise security, suitability, and employment questions without merging the resulting notices.

Key takeaways

  • Classify the notice first. Clearance, suitability, fitness, and probationary employment actions are distinct.
  • Confirm your regulatory status. Part 731 uses applicant, appointee, and employee as defined terms.
  • Answer the actual charges. Request relied-on materials and connect supporting records to each disputed fact or explanation.
  • Check the current appeal route. New suitability-action appeals go to OPM under the revised process, subject to the transition rule for older filings.

How should a federal employee on probation respond to a clearance or suitability notice?

Start by identifying the proposed decision and its legal authority. Ask the issuing office to clarify ambiguous routing or status information, then prepare the response required by that process. A suitability response is not automatically a clearance response, even when the allegations overlap.

The current 5 CFR Part 731 distinguishes suitability actions from national-security eligibility determinations. Its current substantive rules include changes effective July 30, 2026; its appeal process changed separately. An older description of federal vetting may therefore give the wrong procedure.

For broader context, public-trust positions and their investigations should not be confused with classified-access eligibility. In the immediate response, the notice’s actual authority matters more than an informal reference to your “clearance.”

Notice concerns Decision being addressed What to confirm
Security clearance or national-security eligibility Eligibility for classified access or a sensitive position The security authority, response office, and procedure
Suitability proposal A defined suitability action under Part 731 Covered status, charges, relied-on materials, and answer instructions
Fitness determination Character and conduct requirements under the applicable fitness authority Agency procedures and any independent review route
Probationary employment termination Continued employment under the cited termination authority HR’s stated basis, effective date, and applicable response or review rights

Does probationary status make you an appointee under Part 731?

It can. The definition covers qualifying subject-to-investigation employment during the first year and extends appointee status through the initial probationary or trial period if that period is longer. This is a regulatory definition, not a synonym for every newly hired federal worker.

Section 731.101(a) covers competitive service, qualifying excepted-service positions that can convert noncompetitively to competitive service, and career Senior Executive Service appointments. Other excepted-service and contractor situations can involve fitness rules instead.

Prior service matters. Under the delegation provision, an agency must treat an appointee who previously converted to employee status in a covered appointment as an employee. Give HR your appointment and prior-service records rather than assuming a new probationary designation settles suitability jurisdiction.

Ask the office to identify the status it is using for the proposed action. That answer helps determine who may act and which suitability procedures apply. It does not itself decide whether the allegations are accurate.

Why do the conduct date and appointment date matter?

Current rules permit appointee suitability cases involving conduct before or after appointment. Employee cases have different authority limits, and OPM’s action on post-appointment conduct requires a proper and sufficient referral. Status and timing must be considered together.

OPM’s referral guidance includes probationary employees in initial-vetting matters involving conduct before application or appointment. That explains how an issue discovered after entry on duty may still concern earlier conduct.

For an employee as defined in the regulation, section 731.105 reserves suitability actions to OPM. Its post-appointment provisions require the appropriate referral. Agencies may still act under separate employment authorities, so an OPM jurisdiction rule does not mean the employing agency cannot address workplace conduct.

Build a timeline. Distinguish when the conduct occurred, when you applied, when you entered on duty, and when the agency learned about the issue. If the notice uses an incorrect date or overlooks relevant prior service, identify the discrepancy with supporting records.

What must an agency-initiated suitability proposal contain?

The agency must give written notice identifying the proposed action, charges, specific reasons, access upon request to relied-on materials, and the right to answer in writing. It must also state the answer deadline and delivery address and explain representation rights.

Section 731.402 governs this agency-initiated process for applicants and appointees. It requires written designation if you choose a representative. OPM-initiated cases use a separate subpart, so confirm the issuer before selecting response instructions.

Request the materials promptly and keep the request and response confirmation. Reading the evidence can reveal whether a charge rests on a factual error, an incomplete timeline, or conduct you acknowledge but need to explain. If access to the materials is delayed, raise that issue with the issuing office and your representative while tracking the stated deadline.

For a separate clearance Statement of Reasons, follow the security process governing that notice. A suitability request for materials should not be assumed to complete a required response in another proceeding.

How should the written answer address facts and factors?

Answer each charge directly, distinguish disputed facts from acknowledged conduct, and attach records that support the explanation. Relate relevant circumstances and corrective action to the suitability factors actually cited, rather than importing a generic clearance-mitigation checklist.

Section 731.202 contains suitability factors and additional considerations. The latter include the position, seriousness and circumstances of the conduct, recency, age, societal conditions, and rehabilitation, to the extent OPM or the agency deems them pertinent. The authorized office decides their relevance and weight.

Use a working index pairing each allegation with the document that answers it. If the issue concerns a financial obligation, for example, distinguish a disputed account, an accepted payment agreement, and proof of actual payments. If the issue concerns an application statement, provide the wording used, the relevant dates, and records supporting your explanation.

Under section 731.403, the agency-proposal answer may include documentation or affidavits and must be submitted no more than 30 calendar days after the date of the notice of proposed action. Track that date carefully; receipt of materials or a phone conversation is not the stated trigger.

What happens to pay and the final decision during the notice period?

For the covered agency suitability process, the regulation protects pay status during the notice period if the respondent is employed in a covered position when notice is served. That condition does not establish permission to retain classified or system access.

Section 731.402 separately requires service at least 30 days before the proposed action’s effective date. Keep this advance-notice requirement distinct from the answer deadline, which runs from the date of the proposal. Ask HR to clarify your actual duty, pay, and access instructions when different offices are involved.

Under section 731.404, the final agency decision must be written, dated, explain the reasons, and identify the appeal route. When decision-making is delegated, the regulation requires appropriate independence between the proposing and deciding employees.

Preserve the proposal, your complete response, delivery confirmation, final decision, and implementation documents. If a separate HR action is also pending, obtain advice on both notices. A response under the suitability process does not automatically stop another action.

Which suitability actions have an appeal route now?

The current route covers defined suitability actions, rather than every unfavorable employment or vetting decision. New appeals under the revised process go to OPM. The transition preserves suitability appeals already filed with MSPB before the new rule’s effective date.

The regulation defines suitability actions as cancellation of eligibility, removal, cancellation of reinstatement eligibility, and debarment. It excludes specified non-selections or competitive-service eligibility cancellations based on an objection or passover, even when the reasons resemble suitability factors.

The final appeal rule became effective September 2, 2026. OPM’s current appeal instructions direct covered new filings through OPM eFile. Do not use an older MSPB filing instruction without checking how the transition applies to your case.

For a covered appointee, the appeal deadline is 30 calendar days after the effective date of the suitability action. This is a different clock from the proposal-answer deadline. The regulation includes filing, counting, and exception provisions; use the current instructions and seek case-specific advice promptly if the notice or timing is unclear.

How do you coordinate security, suitability, and HR contacts?

Keep an index of each notice, issuer, authority, proposed outcome, deadline, and response destination. Ask each office what its process requires without assuming an answer to another office completes that requirement.

The discussion of representation during clearance investigations can help frame a separate security concern. When suitability and employment notices overlap, take the full set to a federal-employment attorney or other qualified representative who can assess the applicable procedures.

Frequently Asked Questions

Does probation mean I have no opportunity to answer a suitability proposal?

No. Covered applicants and appointees facing an agency-initiated Part 731 action have the specified written-notice and answer procedure. A probationary termination under another authority requires a separate assessment of the rights provided by that authority.

Is a clearance denial automatically a suitability action?

No. The regulation separates suitability from national-security eligibility determinations. Identify whether the agency has also proposed a defined suitability action or a separate employment action; the security decision alone does not establish the suitability appeal route.

Should every probationary termination be appealed through OPM’s suitability process?

No. OPM’s suitability appeal process applies to covered suitability actions. Other termination, fitness, security, or credentialing decisions may have different procedures or independent review options. Confirm the authority and jurisdiction with your representative.

What should I do first after receiving overlapping notices?

Save the complete notices and record the date on each, how it was served, and every stated deadline. Send the issuing office a request identifying the relied-on materials and any routing question, while arranging advice on the actual authorities cited.
